EEC - RESTRICTIONS ON EXPORTS OF COPPER SCRAP

Recourse to Article XXIII:2 by the United States
Report of the Panel adopted on 20 February 1990

1. The Council of Representatives at its meeting on 19 July 1989 agreed to establish a Panel to examine under Article XXIII:2 the complaint by the United States, concerning quantitative restrictions imposed by the EEC on the export of copper scrap (L/6518).

2. The terms of reference of the Panel were:

"To examine, in the light of the relevant GATT provisions, the matter referred to the Contracting Parties by the United States in document L/6518 and to make such findings as will assist the Contracting Parties in making the recommendations or in giving the rulings provided for in Article XXIII:2."

3. The composition of the Panel was:

    Chairman: Mr. Hassan Sampurna Kartadjoemena

    Members:

      Mr. Crawford Falconer

      Mr. Sandor Simon

4. The Panel met on 10 November 1989.

5. On 18 January 1990 the members of the Panel were informed that as a result of bilateral consultations between the United States and the EEC, the matter referred to the Panel had been satisfactorily resolved and that the United States formally requested that the dispute settlement proceedings of the Panel currently underway be terminated.
